On January 5, 2010, Keryx Biopharmaceuticals, Inc. issued a press release announcing that it had reached agreement with the United States Food and Drug Administration regarding a Special Protocol Assessment on the design of a Phase 3 clinical program for Zerenex.  A copy of such press release is being filed as Exhibit 99.1 to this report and is incorporated herein by reference.
