Father transferred overseas by government gains time with son

Chicago, Oct 6, 2020 (Issuewire.com) - A father in a tight spot came to Fathers' Rights attorney Jeffery M. Leving for help.

This dad, employed by the U.S. government, is divorced, and has parenting time with his pre-school son on weekends and some holidays. He now lives out of state, but has been travelling back to Illinois to see his son. Unfortunately, because of the coronavirus, travel is no longer viable. Furthermore, his employer is assigning him overseas, which will reduce even further his opportunity to see his little boy.

He wanted to see his son for three weeks, at dad's home, before he left for his overseas assignment. The reality is that with a divorce and an allocation judgement and parenting plan in place, and the mother objecting to the request, the judge did not have to allow this.

"My legal team had to go to court and make the point that unusual circumstances have arisen, and ask the judge to recognize this devoted dad's urgent need," Leving says. "This wasn't a case that was compelled by the law. This case could have gone either way. But we appealed to the judge's sense of compassion, devotion to justice and the best interests of the child. The hearing took two days, and we won. The judge granted our client what he wanted - parenting time with his little boy for three weeks at dad's home."

Leving will talk about this victory, modified for broadcast, on the Dads Rights Legal Hour, 9-10 a.m. CDT on Saturday, Oct. 10, on Power 92.3 FM in Chicago. The result is a cause for jubilation for this loving father. Without it, he probably would have gone over a year without seeing his child. "I'm proud of my legal team for winning a decision that wasn't just a legal matter," Leving says. "This really required strategic planning and some tugging at the heartstrings, but we did it, and I'm overjoyed for this dad."

Leving also will urge listeners to fill out the census, if they haven't already done so. The census was due to end on Sept. 30, but a federal judge ordered the census kept open until the end of October.

"I especially urge fathers to fill out the census. Making sure that you and your children count is a gift that will last a decade, and it will have an impact on their opportunities in education, public safety and job prospects. I know you're busy, but take 10 minutes for yourself, your family, your community and everyone's future to complete this form," Leving says.

The census form is at 2020Census.gov.

"The census is a crucial part of any effort to see that all communities are properly represented," Leving says. "A community that has a high census response rate is a community that EXISTS politically, socially, economically, and in academic research. For the good of our community, please stand up and be counted, so you count."
