In a recent interview, leading Cleveland criminal defense attorney Edward R La Rue, founding partner of the Law Offices of Edward R La Rue, discussed how sex crime offenses differ from most other criminal cases.

When asked for a comment, he said, “One of the major differences between a sex crime and most other criminal cases is that the consequences are more severe. For example, if you’re faced with a sex crime after a date goes wrong, it’s important to know what these consequences are and how a criminal defense attorney experienced in defending sex crimes can help you.”

Individuals convicted of sex crimes tend to serve more time in prison than those convicted of other types of crimes.

“This is particularly true if a minor is involved in the sex crime case. Depending on which tier the sex crime falls into in the state of Ohio, someone accused could face decades behind bars or even life imprisonment,” La Rue said.

He mentioned that if a twenty-one year old goes on a date with a girl who says she's eighteen and then he finds out she was only fifteen the consequences could be extremely grave.

The punishment for sex offenders doesn't end in prison. A sex crime conviction requires offenders to register for at least ten years in Ohio, even for convictions that are categorized in the lowest tier.

“In Ohio, all adult registration lists are made public, meaning that registration requirements can have far-reaching implications, such as difficulty in obtaining employment or housing as well as damage to one’s reputation in the community,” he said.

According to La Rue, both law enforcement and prosecutors tend to be more aggressive and close-minded about the facts of the case when it comes to sex crimes, leading to harsher punishments.

When asked about the reason behind this, La Rue said, "Overall, society perceives that sex crimes are more deserving of punishment than most other crimes - some argue the penalties should be as severe as those for homicide - especially if a minor is involved.”

Sex crime cases also differ from other criminal cases in that the burden of proof is often shifted, in the layman’s mind, onto the defense.

When asked to elaborate, La Rue said, "In all criminal cases, the burden of proof lies with the prosecutor. However, while the evidence needed to defend someone for a drug possession or even a violent crime is perceived as always needing to be proven by the Government or prosecutor, in sex crimes cases, there is often a bias so strongly against those accused, that in essence, we find ourselves having to ‘prove’ the defendant’s innocence in most instances so as to have any chance to win at trial. This requires that the criminal defense attorney be experienced in the defense of this kind of case, and that they are well-versed
